ACT Skilled Migration Program closed to overseas applicants until July 2017

Effective 14 September 2016, if you are living overseas you cannot apply for ACT nomination of a Skilled Nominated (subclass 190) visa until July 2017. 

Canberra residents

This action does not affect Canberra based applicants. You are still able to apply for ACT nomination if you meet the nomination criteria.

Streamlined PhD nominations

The ACT will accept applications for streamlined nomination from ACT PhD alumni living overseas.  If you meet the nomination criteria, email migrationservices@act.gov.au for advice on how to lodge the online application. 

ACT Occupation List will be updated in July 2017

The demand for ACT occupations will be reassessed in July 2017. The updated ACT Occupation List will be published when the ACT Migration Program reopens to overseas applicants in July 2017,

Regional Sponsored Migration Scheme (RSMS)

The Regional Sponsored Migration Scheme visa (subclass 187) is a permanent residence visa for skilled workers who have been nominated by an employer to live and work in regional Australia. There are three streams for employers in Canberra who want to nominate a skilled overseas employee for permanent residence under the Regional Sponsored Migration Scheme (RSMS):

RSMS streams

Temporary Residenc​e Transition Stream

You may nominate an employee under this stream if they have worked for you in the nominated position for at least two years on a subclass 457 visa. The employer nomination is lodged with the Department of Immigration and Border Protection without input from the Regional Certifying Body (RCB).

Direct Entry S​tream

The Direct Entry stream is for an employee who has NOT worked for the employer on a subclass 457 visa for at least two years.

The employer must seek the opinion of the local Regional Certifying Body (RCB) about whether the employer nomination meets specific migration requirements. Assessment by the RCB is a legislative requirement for the approval by the Department of Immigration and Border Protection of a RSMS nomination under the Direct Entry stream. A Direct Entry RSMS nomination cannot be approved without advice from the relevant RCB.

The RCB in Canberra is Innovate Canberra, Chief Minister, Treasury and Economic Development Directorate, ACT Government.

Agreements Stream

The Agreements stream is for employees who are sponsored through a labour or regional migration agreement. The Agreements stream does not require assessment by the Regional Certifying Body.

Meeting the criteria for RCB support

Regional Certifying Body criteria - (Fee $300)

The RCB assesses information provided by the employer against three criteria to form an opinion on the nominated position. The three criteria are established by the Department of ImmiArticlegration and Border Protection:

  • Genuine need;
  • Labour market  - position cannot be filled locally; and
  • Employment conditions.

ACT Occupation List - updated 10 September 2016

The ACT Occupation List will help employers determine whether the position is in demand in Canberra and therefore meets the RCB labour market criteria. If the position is not in demand, the RCB guidelines will explain other LMT options.

Before you apply for RCB support of a direct entry employer nomination, you must first lodge the online application for ‘Employer nomination under the RSMS’ with the Department of Immigration and Border Protection.

  • Employers applying for RCB support must create an 'Employer account'. 
  • Migration agents lodging an application on behalf of a client must create an a 'Agency account'.
